Strange world of Copy rights violations

It has sort of become a trend for the Hindi films. Whenever a movie which has a lot of anticipation and pre–release built up, it is mired in one kind of controversy or the other. The trend started getting manifested with KRAZZY–4, and the dissenters having tested blood try to repeat the same with subsequent big films. It had happened therefore with JODHAA AKBAR and now it is happening with two of the releases that are going to hit the silver screen on 25 December, they being two of the biggest films rounding off the year 2008, GHAJINI and JUMBO.

The controversies are also innate. Controversy associated with GHAJINI is that the rights for remake were not provided for Hindi but for Telugu. If that was the case, then when GHAJINI went to the floor, at that point of time only dissenting voices ought to have been raised, but they were not done. Now that GHAJINI has created history by grossing more than the input costs, even before the film has been released, the idea of raising the voice points to the fact that some quantum of moolah is expected. The court has also stayed the release of the film, but when it goes into hearing it would become amply clear that the dissent has no basis when it is being released at this point of time.

Same is the case with JUMBO. A Hindi author, Hari Kishore, has filed case against the film claiming that the story idea is a lift from on of his books. The moot point is that JUMBO is a remake of a Thai film KHAN KLUAY, and was the first 3–D animation film from Thailand. Without knowing that Percept Communications has not made the film, but a Thai company, the writer has sought injunction against Percept films.

From the above it is clear that as two big production houses are involved in GHAJINI and JUMBO, they would part with some cash so that the film is not delayed. A lesson also needs to be learnt by the film fraternity that hence forth if they are going in for remakes, they should cross check all kinds of loop holes, and also come out with notices at the launch of the film itself about having claimed remake rights, and that if anybody has any objection it ought to be clarified immediately, otherwise no claims after completion of the film would be entertained. It would mitigate quite a lot of heart burns.
